Challenge Accepted – Combined Indoor & Outdoor Waiver and Agreement

Location: Challenge Accepted Facilities and Designated Outdoor Fields

1. Participant Agreement

By signing this document, I acknowledge that participation in Challenge Accepted activities (including but not limited to Gelsoft, Gelball, Laser Combat, Nerf, birthday parties, and similar tactical games) involves adventurous recreational activities with inherent risks. I voluntarily assume all such risks, including those arising from natural or man-made hazards, equipment failure, or the actions of other participants.

2. Activities and Risks

I understand that activities may include, but are not limited to:

• Use of Gelball, Gelsoft, Nerf, or Laser equipment

• Movement over uneven terrain, bushland, constructed barricades, bridges, jetties, stairs, indoor obstacles, or CQB setups

• Exposure to water hazards, which must not be entered

• Potential encounters with snakes, spiders, ticks, mosquitoes, wasps, insects, or other wildlife 

• Exposure to heat, sun, or weather conditions, including risk of heatstroke, dehydration, or sunburn 

• Exposure to indoor risks such as trip hazards, low lighting, equipment misuse, or accidental collisions

• Travel on or near private property in the course of outdoor activities

I acknowledge that participation may result in injury, illness, disability, or death, and may also result in loss, damage, or theft of personal property.

3. Health and Fitness

I declare that I am physically fit to participate and have disclosed all relevant medical conditions to Challenge Accepted staff. I agree to cease participation and notify staff if I feel unwell or unsafe. I will take reasonable precautions for my own safety, including wearing appropriate clothing, enclosed footwear, sun protection, and mosquito repellent as applicable, and staying hydrated.

4. Safety Briefing and Protective Equipment

• I acknowledge that a mandatory safety briefing will be conducted prior to each session, and I will follow all instructions.

• I agree to wear approved eye protection and other safety equipment at all times during gameplay or as instructed by staff.

5. Liability Release and Indemnity

I hereby release, discharge, and indemnify Challenge Accepted, its owners, staff, volunteers, agents, and the property owner(s) from all claims, demands, or proceedings arising from my participation in any activities, including injury, death, loss, or damage, except where caused by proven negligence.
I accept full responsibility for my actions and agree not to sue Challenge Accepted or the property owner(s) for any injury, damage, or loss.

6. Insurance

I acknowledge that participants are responsible for their own personal or medical insurance coverage as desired. Challenge Accepted and property owners do not provide additional coverage for participants.

7. Medical Treatment

I consent to first aid or medical treatment that Challenge Accepted staff deem reasonably necessary during or after activities.

8. Personal Property

I acknowledge full responsibility for my personal belongings. Challenge Accepted accepts no liability for lost, stolen, or damaged property.

9. Alcohol and Intoxicants

No alcohol or other intoxicating substances may be consumed on-site during sessions. Challenge Accepted reserves the right to refuse entry or remove any participant deemed under the influence.

10. Media Release

I grant Challenge Accepted permission to photograph or video me during activities for promotional, broadcasting, or reporting purposes in any media format.

11. Legal Terms

• Legally Binding: This document is a contractual agreement affecting legal rights.

• Free Will: I sign this agreement voluntarily and am not induced to participate by Challenge Accepted.

• Ongoing Effect: This agreement remains in effect until terminated by law or Challenge Accepted.

• Severability: If any provision is invalid or unenforceable, remaining provisions remain fully effective.

• Variation: No changes are valid unless in writing and signed by Challenge Accepted.

12. Acknowledgment

I have read, understood, and agree to all terms in this agreement, including all risks, safety rules, and liability releases, and I voluntarily accept them.
